Today i went to see Andrew and a friend pike fishing a local pool. I had a walk around the pool to see 3 other people piking, i asked how they getting on and the had all caught fish on Livebait. I think they had transport livebaits from one venue to another to use. I personally feel this to be unacceptable behavior the fish could be diseased and transmite it to the pool they are fishing. Can you be caught in the act and prosecuted for the offence.

The straight forward answer to your question Frank is yes! introducing fish into any water regardless of whether they are intended as stock or bait requires a Section 30 consent form from the EA. Failure to comply with this can result in prosecution.
That said many pike anglers do this.The main reason is that sadly good conditions for catching pike on live baits are also very poor for catching bait fish. The convienience/efficiencey of having a well kept supply of live bait available doesnt need explaining.
The majority of pike anglers who go to all the effort of aquiring,keeping and transporting lives are normally experienced and make every effort to ensure that their actions cause no problems.The two main problems as seen by the EA are the spreading of disease (as you mention) and the possibility of translocation of species ie introducing a non indigenous species to a water.
At this point I would like to point out the two FACTS that many live baiters who do this use to justify breaking the law (and more importantly not causing the two problems mentioned) There has never been a proven case of disease or a species being transfered by an anglers bait. This despite the practice having been carried out for several centureys.
The section 30 regulations being brought in to really control the spread of disease/species through stocking by both the normal and ornemental fish trade.
You can in theory get a Section 30 consent to use in con junction with your live baits.In reality though if you are buying trout from a farm for bait you are told by the authorities not to bother!
Like a lot of things in angling it is a practice that needs to be given a bit of thought and done properly.
That said it is still ilegal so you pays your money and takes your chance.

Brilliant reply Budgie. But i think i can see what Frank is trying to say, yes it is a section 30 offense, but how can you prove or get the EA to stop this. I think it is diabolical and wrong to use livebait caught from another venue. But i have never in 30 years of angling ever been asked to produce my rode license. Sad really. So its going to be even harder to catch somebody illegally using livebait.

Its right what you say Max.If live baiting were to be banned it wouldnt affect me in the slightest! i would carry on as normal with very little worry about being caught/prosecuted.If they cant even be bothered to check my licence (not been checked since 1988 and then only once before that in over 40 years!) I cant see a bailiff trudging a few miles along the river/drain on a cold winters day in the week to see what bait Im using.Can you?
My only worry about live baiting being banned is that I see it as another nail in Angling in generals coffin. If we admit to live baiting being cruel we must surely be acepting that fish feel pain/fear and there fore angling is cruel full stop?
As I always say-in the eyes of a non fisherman what is the difference in sticking a hook in a fish and casting it out and casting out and sticking a hook in a fish and winding it in?
To get around the live bait fish transfering rules/possible(?) problems a lot of pikers catch fish and then keep them in a cage on the same water to use as and when on that water for bait.It is easy enough to sink a cage out of sight of others.
One trout reservoir I fish has a problem with a parasite so I always keep the baits for this water there and they obviously never get used any where else.As I said before just a case of using some common sense.Sadly lacking in many though and why the rules exist.
